By calling 260-PHONE-ME, creating an account, or using the 260phone.me website ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
260-PHONE-ME provides an AI-powered phone assistant accessible via telephone. The Service includes real-time voice conversations, persistent memory of your preferences and personal details, web-based account management, and prepaid credit billing. The Service is powered by third-party AI models and may produce inaccurate or unexpected responses. It is not a substitute for professional advice of any kind (medical, legal, financial, or otherwise).
You create an account by calling in and setting a 4-digit PIN. You are responsible for keeping your PIN and password secure. You must be at least 18 years old to use the Service. One account per phone number. We may suspend or terminate accounts that violate these terms.
The Service uses a prepaid credit model. You purchase credit in advance and it is deducted as you use the Service at the posted per-minute rate. Credit is non-refundable except where required by law. We may change pricing with 30 days notice. You will not be charged beyond the credit on your account — when your balance reaches zero, the call ends. Payment processing is handled by Stripe. We do not store your full credit card number.
You agree not to: use the Service for any illegal purpose; attempt to abuse, overload, or interfere with the Service; use automated systems to place calls; impersonate another person; or attempt to extract, reverse-engineer, or exploit the underlying AI models.
The Service stores information you share during calls ("Memories") to personalize future conversations. You can view, edit, and delete your Memories at any time on the website. You should not share sensitive data such as social security numbers, credit card numbers, or passwords during calls. While we take steps to discourage storage of such data, we cannot guarantee detection in every case and you are responsible for the information you choose to share. You may delete your account at any time from the website dashboard. Deletion permanently removes all stored Memories, call history, and transcripts. Any remaining credit balance is forfeited upon deletion.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted availability, accuracy of AI responses, or fitness for any particular purpose. AI-generated responses may be incorrect, incomplete, biased, misleading, or inappropriate. Do not rely on the Service for emergency situations, medical advice, legal counsel, financial decisions, or any situation where inaccurate information could cause harm.
You acknowledge that all responses from the Service are generated by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your situation. You assume full responsibility for any actions you take based on information provided by the Service. Data Divination LLC is not liable for any damages, losses, injuries, or consequences — direct, indirect, incidental, or otherwise — resulting from your reliance on AI-generated content. This includes, without limitation, financial losses from investment or business decisions, harm from following medical, legal, or safety-related suggestions, emotional distress, property damage, or personal injury. The Service does not provide professional advice of any kind, and nothing it says should be treated as such.
To the maximum extent permitted by law, Data Divination LLC's total liability for any claim arising from use of the Service is limited to the amount of credit you have purchased in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Data Divination LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your reliance on AI-generated content, or your violation of these terms.
We may update these terms at any time. We will notify you of material changes via the website or during your next call. Continued use after changes constitutes acceptance.
